Hereinafter referred to as "Yoga Spirit."
Purpose
These General Terms and Conditions of Sale (GTC) govern the relationship between Yoga Spirit and any individual visiting or making a purchase through the website www.yogaspirit.mu, hereinafter referred to as "the Customer." They define the terms of distance selling, from order placement to delivery, including payment. By placing an order, the Customer acknowledges having read, understood, and accepted these GTC. These conditions may be amended at any time by Yoga Spirit; the applicable GTC are those in effect on the site at the time the order is placed.
- Products
The products offered for sale are those listed on the website www.yogaspirit.mu on the day the Customer visits the site. They are offered subject to availability and are described and presented with the greatest accuracy possible.
- Prices
Prices are indicated in euros (EUR) including all taxes (TTC). Delivery costs are the responsibility of the Customer, unless otherwise stated. Yoga Spirit reserves the right to modify its prices at any time, but products will be billed based on the rates in effect at the time of order registration.
- Order
To place an order, the Customer must identify themselves or register on the site by completing the "Create My Account" form. The order confirmed by the Customer constitutes acceptance of the prices and descriptions of the products available for sale. A confirmation email summarizing all the information will be sent to the Customer after the order is validated.
- Payment
Payment is made online by credit card (Visa, Mastercard, PayPal) or via Juice By MCB. The invoice will be included in the package containing the ordered products. In the event of out-of-stock items, a credit note will be sent by email within 3 business days.
- Payment Security
The website www.yogaspirit.mu uses the secure payment service MIPS, which integrates the 3D secure standard (3 domain secure).
- Delivery
Delivery times are 15 business days for standard delivery (paid) and 5-6 business days for express delivery (paid). Orders are shipped to Mauritius, Madagascar, Rodrigues, Comoros, Mayotte, Seychelles, Sri Lanka, Kenya, Tanzania, Mozambique, Zimbabwe, Zambia, Botswana, Namibia, South Africa, Lesotho, Malawi. The Customer must check the condition of the packaging and the conformity of the products upon receipt.
Delivery delays cannot give rise to compensation or claims against the seller if such delays are due to the Consumer, an insurmountable and unforeseeable event caused by a third party to the contract, or a force majeure event.
The ordered Product(s) is/are delivered to the delivery address provided by the Consumer when placing the Order. The Consumer must ensure that the information provided and mentioned in the confirmation email is correct and remains so until the complete delivery of the ordered Product(s). Therefore, the Consumer undertakes to inform the Company of any changes in billing and/or delivery details that may occur between the Order and delivery by sending an email to the customer service email address without delay.
Otherwise, in case of delay and/or delivery error, the Consumer cannot hold the Company responsible for non-delivery, and the Company's Customer Service will contact the Consumer for a second delivery at the Consumer's expense.
YOGA SPIRIT LTD will also not be held responsible if the non-receipt of Products is due to a third party outside of its control or in case of theft.
The Consumer who accepts a product without making reservations to the carrier accepts it as is. They are then barred from making any claims regarding the delivery.
- Right of Withdrawal
The Customer has a 14-day right of withdrawal from the receipt of the order. To exercise this right, the Customer must return the withdrawal form by email or post. Return shipping costs are the responsibility of the Customer. Yoga Spirit will refund the Customer within a maximum of 14 days following the withdrawal.
- Returns and Exchanges
Returned products must be unworn and in their original packaging. The Customer can return products by post or in-store for an exchange or refund in the form of a credit note.
- Personal Data Protection
The information collected is intended for Yoga Spirit to process orders and communicate with the Customer. The Customer has the right to access and rectify their personal information by contacting Yoga Spirit by email or post.
- Intellectual Property
All elements of the website www.yogaspirit.mu are protected by copyright, trademarks, or patents. They are the exclusive property of Yoga Spirit.
All elements of this Site and the Site itself are protected by copyright, trademark law, design, and model law, and/or any other intellectual property rights. These elements are the exclusive property of the Company. All such rights are reserved worldwide.
The names and trademarks YOGA SPIRIT, logos, designs, models, stylised letters, figurative trademarks, and all signs represented on this Site are and will remain the exclusive property of the Company.
No title or right of any kind to any element or software will be obtained by downloading or copying elements from this Site. It is strictly forbidden for the Consumer to reproduce (except for personal and non-commercial use), publish, edit, transmit, distribute, display, remove, delete, add to this Site and the elements and software it contains, modify them or create any derivative works from them, or sell or participate in any sale related to this Site, the elements of this Site, or any related software.
The Company grants the Consumer a non-exclusive license to use the Site. This license is strictly personal and cannot be transferred to any third party. The license is granted for the duration of use of the Site.
Any use by the Consumer of corporate names, trademarks, and distinctive signs belonging to the Company is strictly prohibited unless expressly and previously authorised by the Company.
- Liability
Yoga Spirit cannot be held responsible for any inconveniences or damages inherent in the use of the Internet. Yoga Spirit also disclaims any responsibility in case of force majeure or fault attributable to the Customer.
- Applicable Law and Dispute Resolution
These GTC are subject to Mauritian law. In case of a dispute, an amicable solution will be sought before any legal action. Mauritian courts shall have sole jurisdiction.
